1. Services

SMB AI Specialists provides business services including AI voice agents, automation systems, SEO/AI visibility optimization, reporting, and consulting. Services may be one-time, subscription, or usage-based.

2. Fees, Billing, and Payment

-Clients agree to pay all applicable fees including one-time, subscription, and usage-based fees.
-Subscriptions are month-to-month and auto-renew unless canceled. Clients may cancel at any time.
-One-time fees are non-refundable.
-If a subscription is canceled within the first 90 days, 50% of fees paid may be donated to a charity of the Client’s choosing. No refunds apply after 90 days.
-Payments are processed via third-party providers such as Stripe.

3. No Guarantees

No specific results are guaranteed, including leads, revenue, rankings, or performance outcomes.

4. Client Responsibilities

Clients must provide accurate information, comply with all laws (including TCPA), and are responsible for how services are used.

5. AI Systems Disclaimer

AI outputs may be inaccurate. Systems may fail or delay. Clients assume all risk related to AI usage and communications.

6. Limitation of Liability

Company is not liable for indirect damages, missed leads, or third-party failures. Liability is capped at fees paid in the prior 3 months.

7. Indemnification

Client agrees to indemnify Company from claims arising from misuse, legal violations, or provided data.

8. Acceptable Use

No illegal use, spam, or abuse. Company may suspend or terminate services for violations.

9. Data Roles

Company acts as a data processor. Client is the data controller and responsible for compliance.

10. Third-Party Services

Services rely on third party software and services as needed.

11. Termination

Company may suspend or terminate services for non-payment or violations.

12. Intellectual Property

All systems and materials remain Company property unless otherwise agreed.

13. Governing Law

Governed by North Carolina law.

14. Changes

Terms may be updated at any time.
